DietitianSmart ("Service") and www.dietitiansmart.com (“Site”) is accessible worldwide to anyone with Internet access. Access to and use of the Service and Site is subject to the terms and conditions of this User Agreement and Copyright Notice and all applicable laws and regulations, including laws and regulations governing copyright.

By accessing the Service and Site, you accept all of the terms and conditions in this User Agreement. DietitianSmart reserves the right to change any and all terms and conditions at any time. By using the Service and Site, you agree in advance to accept any changes and/or modifications. The materials used and displayed on the Service and the Site, including but not limited to text, photographs, software, illustrations, artwork & graphics, video, music, sound, and names, logos, trademarks and service marks, are the property of DietitianSmart and is protected by copyright and other applicable laws. You agree not to reproduce, retransmit, sell, disseminate, publish, broadcast, or circulate any such material without explicit written consent (permission) of DietitianSmart. Any such content may be displayed solely for your personal, non-commercial use. Employers, Human Resources, Recruiters, Ad agencies and the like, agree not to post or transmit any unlawful, threatening, abusive, harmful, harassing, defamatory, obscene, profane, racially, ethnically or otherwise offensive material of any kind, including but not limited to, material which encourages conduct that would constitute a criminal offence, violate the rights of others, or otherwise violate any applicable local, state, national or international law. Employers, Human Resources, Recruiters, Ad agencies and the like will be responsible for, and indemnify and hold harmless, DietitianSmart and its Principal and Owners, agents and representatives against any claim arising from any material that you post or transmit.

DietitianSmart, its Principal, Owners, Affiliates, Agents, Representatives, or Licensor's shall not be liable to you or anyone else for any loss or injury, or any direct, indirect, incidental, special, punitive, or similar damages arising out of your access or use of, or your inability to access or use, the Service and the Site and the information available on the Service and the Site, or arising out of any action taken in response to or as a result of any information available on the Service and the Site. You hereby waive any and all claims against DietitianSmart and its Principal, Owners, Affiliates, Agents, Representatives, or Licensor's arising out of your use of the Service and the Site.

Any communication or material you list or transmit to the Service and the Site is, and will be treated as, non-confidential and non-proprietary. Employers, Human Resources, Recruiters, Ad agencies and the like, assume full responsibility for postings or transmittals and grant DietitianSmart and its affiliates the right to edit, copy, publish, and distribute any information or content you post or transmit for any purpose. DietitianSmart and its affiliates are not responsible for the content of any such linked web sites. Your linking to such web sites is at your own risk. Employers, Human Resources, Recruiters, Ad agencies and the like are advised that if you voluntarily disclose personal information (e.g., user name, e-mail address), such information may and can be harvested and used by others and may result in unsolicited messages from other parties. This User Agreement and any disputes arising out of, or related to, the Service and the Site shall be governed by, and construed and enforced in accordance with, the laws of the State of California.
